Introduction

This Acceptable Use Policy ("AUP") governs the use of ZYNEXTEK services, infrastructure, and network resources ("Services") by all customers, users, and their end-users (collectively, "You" or "Customer"). By using our Services, you agree to comply with this AUP. Violation of this policy may result in service suspension, termination, or legal action.

This AUP should be read in conjunction with our:

We reserve the right to modify this AUP at any time. Continued use of our Services constitutes acceptance of any modifications.

1. Prohibited Activities

1.1 Illegal Content and Activities

You may not use our Services for any illegal purpose or in violation of applicable laws, including but not limited to:

• Child Exploitation: Any content involving minors.

• Adult Content: Hosting or distributing pornography is prohibited.

• Fraudulent Activities: Phishing, scams, Ponzi schemes, or deceptive practices.

• Identity Theft: Trading stolen personal data or financial information.

• Illegal Goods: Selling stolen accounts, weapons, drugs, or contraband.

• Copyright Infringement: Distributing pirated software, warez, or media.

1.2 Security Violations

• Unauthorized system or network access.

• Credential testing, brute force attacks, or account cracking.

• Exploiting vulnerabilities without written authorization.

• Network scanning or penetration testing without approval.

• Hosting malware, botnets, or ransomware.

• IP spoofing or falsifying packet headers.

• Unauthorized collection of private or financial data.

1.3 Network Abuse

• DDoS attacks or facilitating denial of service.

• Email Abuse:

  • All outbound email is prohibited unless approved.

  • No mail servers, bulk mailing, or email verification tools.

• Public VPNs or open proxies without permission.

• DNS amplification or abuse.

• Running IRC servers, clients, or bots.

• Torrenting and peer-to-peer file sharing are strictly prohibited.

1.4 Content Violations

• Hate speech, violence, or discrimination.

• Harassment or defamation.

• Terrorism-related content.

1.5 Resource Abuse

• Cryptocurrency mining without written permission.

• Excessive resource consumption affecting other customers.

1.6 Account Violations

• Ban evasion after service termination.

• Operating multiple accounts to bypass restrictions.

2. Resource Usage Policies

2.1 CPU Usage

• Short-term spikes to 100% are acceptable.

• Sustained usage above 90% for more than 2 hours may be throttled.

2.2 Disk I/O

• Maximum average of 300MB/s read/write for more than 10 minutes is prohibited.

2.3 Network Usage

• Sustained maximum bandwidth usage for more than 2 hours requires approval.

• Activities degrading network performance are not allowed.

3. Compliance and Legal Obligations

3.1 Customer Responsibilities

• Maintain secure passwords.

• Keep software updated.

• Report security incidents immediately.

• Comply with all local, federal, and international laws.

3.2 Law Enforcement Cooperation

ZYNEXTEK may disclose customer information to law enforcement when presented with a valid subpoena.

3.3 DMCA Compliance

We respond to valid DMCA takedown requests. Repeat violations may result in termination.

4. Enforcement and Remedies

• Warnings may be issued for violations.

• Services may be suspended or terminated without refund.

• Illegal activity will be reported to authorities.

• Administrative costs may be billed at $30/hour for investigations.

6. Indemnification

You agree to indemnify and hold ZYNEXTEK harmless from any claims, damages, or expenses arising from your violation of this AUP.
